General Terms of Use Ticket Shop
General Terms and Conditions for the online purchase of tickets on the website of the respective Deutsche Messe AG event.
The following General Terms and Conditions (hereinafter referred to as "GTC") apply to contracts for the online sale of e-tickets and registration codes (hereinafter referred to only as "Tickets") between Deutsche Messe AG, Messegelände, D-30521 Hannover (hereinafter referred to as "Deutsche Messe") and the purchaser using the online ticket shop of the respective event website (hereinafter referred to as the "Website").
Deutsche Messe reserves the right to amend these GTC at any time, with such amend-ments taking effect as soon as they have been published on this Website. Deutsche Messe also reserves the right, at its sole discretion and without prior notice, to discontinue or modify the Website in whole or in part.
By placing an order, the purchaser of Tickets (hereinafter referred to as the "Customer") accepts these GTC. Deviating conditions of the Customer shall not be valid.
The Customer agrees to use this Website exclusively to purchase Tickets. Without express permission, it is prohibited to establish deep links to this Website — for any purpose whatsoever.
The Customer undertakes not to use any robot or spider software, nor to attempt in any other way — either automated or manual — to monitor or copy this Website and its content. He also undertakes not to disrupt the proper functioning of this Website in any way whatsoever, and in particular by deliberately overloading Deutsche Messe's system infrastructure.
Deutsche Messe will investigate any illegal and/or unauthorized use of this Website, including but not limited to unauthorized Ticket purchases, unauthorized framing of or linking to the Website, or unauthorized use of any robot, spider, or other software, and will take appropriate civil and criminal action.
Deutsche Messe is the issuer of the Tickets. The purchase of Tickets creates a contractual relationship exclusively between the respective Customer and Deutsche Messe.
The Customer first creates a user account with Deutsche Messe. The Customer can then purchase Tickets from Deutsche Messe.
By clicking the corresponding button, the Customer sends his order and submits a binding offer for the conclusion of the Contract. During the order process, the Customer must enter specific information on the order quantity (number of Tickets), his correct e-mail address as the delivery address and all data necessary to process the payment.
Once the order has been sent and received, the Customer will receive an e-mail confirming the purchase. With the sending of this confirmation notice (hereinafter referred to as the "Purchase Confirmation"), the contract of sale for Tickets between the Customer and Deutsche Messe comes into effect (hereinafter referred to as the "Contract").
The Purchase Confirmation also includes the invoice. The Tickets are provided to the user in PDF format as well as in the form of a wallet for download in his user account directly after the purchase is completed.
The PDF entitles the holder to enter the exhibition grounds on the relevant event days both via digital display on a mobile device (e.g. smartphone) and in printed form. The Customer can save the wallet Ticket on a mobile device and use it as an access medium.
If the event provides for the personalization of Tickets, the Tickets must be personalized as part of a registration process.
After creating a user account, the Customer can log in to the ticket shop and purchase a ticket personalized in his name (e-ticket). He can also order Tickets in the form of registration codes for third parties.
If the Customer has purchased Tickets for himself, he will receive the Tickets personalized for him in PDF format. The PDF entitles the holder to enter the exhibition grounds both via digital display on a mobile device (e.g. smartphone) and in printed form. If a wallet Ticket is provided to the Customer with the Purchase Confirmation, the Customer can save it on a mobile device. The wallet Ticket can thus be used as an access medium.
The registration codes will also be available in the purchaser's login area (user account) directly after the purchase if the Customer indicated in the purchase process that he wished to purchase Tickets for third parties. The registration codes can be passed on by him to third parties. Recipients must first register on their own using the registration code on the event Website. Only after successful registration will the third party be provided with the Ticket via e-mail and download. The registration code as such does not grant the holder admission to the event.
By way of principle, purchased Tickets (incl. registration codes) may not be returned. Each order of Tickets is therefore binding immediately upon receipt of the confirmation email and obliges the Customer to accept and pay for the transmitted Tickets. There will be no refund of the purchase price for unregistered or unused registration codes.
An exception applies only to Tickets for (a) canceled or (b) rescheduled events. In these cases, the original Customer is entitled to a refund of the Ticket price actually paid. Tickets do not have to be returned, but are automatically declared invalid. Furthermore, no claims for reimbursement of wasted expenditure will be entertained.
In case of loss of Tickets, a refund of the purchase price is not possible.
Right of withdrawal
A right of withdrawal for consumers does not exist for the following contracts:
Contracts for the provision of services in the fields of accommodation other than for residential purposes, transport of goods, car rental services, deliveries of food and beverages, or services related to leisure activities, if the Contract provides for a specific date or period of performance (Section 312g (2) Sentence 1 No. 9 of the German Civil Code (BGB)). This means that insofar as Deutsche Messe offers services in the field of leisure activities, in particular Tickets for event activities that take place at a specific time, there is no right of withdrawal.
For all other contracts for Tickets the following applies:
If the Customer is a consumer within the meaning of § 13 BGB, he may revoke his declaration of intent to conclude the Contract within 14 days without stating reasons by using the withdrawal form (a sample withdrawal form can be found below) or by making an express declaration (e.g. letter, e-mail, fax) to Deutsche Messe. To meet the deadline, it is sufficient to send the withdrawal form or to submit the withdrawal declaration to Deutsche Messe in good time. The withdrawal period begins with the conclusion of the Contract, but not before the consumer has been informed by Deutsche Messe in accordance with the statutory requirements (Section 312 j (2) BGB in conjunction with Art. 246a § 1 (1) sentence 1 no. 1, 4, 5, 11 and 12 of the Introductory Law of the Civil Code (EGBGB)).
Withdrawal is only possible within the withdrawal period until the time at which the Ticket loses its validity, i.e. at the end of opening hours on the respective day (day Tickets) or last day of the trade fair.
The withdrawal declaration must be sent to:
Deutsche Messe AG
Messegelände
D-30521 Hannover
Tel.: + 49 511 89-37777
Fax: +49 511 89-32342
E-Mail: service-hotline@messe.de
Consequences of a withdrawal
If the right of withdrawal is effectively exercised, the Tickets in question will be blocked so that access to the respective event will not be possible. In the event of an effective withdrawal, Deutsche Messe will refund the Ticket price already paid by the consumer without delay, but no later than after 14 days.
For the consumer, the period begins with the sending of the withdrawal form or the submission of the withdrawal declaration, for Deutsche Messe upon receipt of the declaration. Deutsche Messe is free to choose the means of repayment for the Ticket price already paid. No fee shall be charged to the consumer.
Sample withdrawal form
In the event of withdrawal in accordance with the above withdrawal policy, the form attached at the end of the document may be completed and returned to Deutsche Messe. Use of the form is not mandatory.
Ticket prices are always subject to change and include the statutory value added tax. The prices stated on the respective Website at the time of the order will apply.
The total price including VAT is due immediately after conclusion of the Contract. Payment can be made by credit card (VISA card, Euro Mastercard) or PayPal.
Tickets remain the property of Deutsche Messe until payment has been made in full. If a payment is charged back, the Tickets / registration codes will be automatically invalidated.
The invoice will be issued by Deutsche Messe AG, Messegelände, D-30521 Hannover, Germany, VAT ID DE 115674754. The respective invoice will be sent to the Customer as a PDF file together with the confirmation notice.
By ordering Tickets, the Customer declares his consent to the creation and sending of invoices electronically in unencrypted form. There is no entitlement to invoicing by invoice document.
For questions regarding payment and/or invoices, please contact Deutsche Messe AG directly (service-hotline@messe.de).
Tickets and registration codes are transmitted by making them available for download in the Customer's user account. Immediately upon receipt of the Tickets, the Customer is obliged to check them for correctness and completeness, i.e. in particular the name of the event, date, time, price and quantity, and to notify Deutsche Messe of any complaints within 3 working days by e-mail to service-hotline@messe.de.
The Customer may not reproduce, duplicate, or modify the Ticket. The purchase of Tickets for the purpose of resale is prohibited.
An unauthorized duplicated or resold Ticket does not entitle the holder to attend the event. The single-use barcode on the Ticket is electronically validated by barcode scanners at the venue. Consequently, there is no way that, e.g. by duplicating the barcode, other persons with the same barcode can gain access to the event.
In the event that copies of the Ticket are discovered, Deutsche Messe reserves the right to deny access to the event to the holders of the copies or the holder of the unauthorized duplicated Ticket. Furthermore, it reserves the right to demand payment of the total value of the duplicated Tickets from the Customer whose Ticket was duplicated without authorization due to his fault.
The Tickets should be kept in a safe place, just like cash or conventional tickets, to prevent misuse. Deutsche Messe bears no responsibility whatsoever in the event of loss and/or misuse of the Ticket.
Deutsche Messe shall be liable without limitation for damage suffered by the Customer only to the extent that such damage is attributable to its intentional or grossly negligent conduct.
In the case of slightly negligent breaches of duty, Deutsche Messe shall only be liable for the breach of one of its essential contractual obligations (cardinal obligation). In that case, Deutsche Messe's liability is limited to the direct damage typical for the Contract and foreseeable at the time of conclusion of the Contract. This also applies to breaches of duty by legal representatives and/or vicarious agents of Deutsche Messe.
Liability for culpable injury to life, limb or health shall remain unaffected by this limitation of liability.
Deutsche Messe does not guarantee that the operation of the Website will be uninterrupted or error-free. It will endeavor, as far as technically possible, to keep the operation of the Website free from errors and interruptions. Deutsche Messe also provides no guarantee that the Website is free of viruses or other sources of disruption. Liability is therefore also excluded in this regard.
The law of the Federal Republic of Germany shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the German text version.
The EU Commission provides a platform for out-of-court online dispute resolution (ODR plat-form), which can be accessed at https://ec.europa.eu/consumers/odr .
Deutsche Messe AG is neither legally obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board pursuant to the German Consumer Dispute Resolution Act (VSBG).
The place of jurisdiction for all legal disputes arising from the Contract shall be Hannover if the contracting parties are merchants, legal entities under public law or special funds under public law or if at least one of the contracting parties does not have a general place of jurisdiction in the Federal Republic of Germany, or relocates its domicile or habitual residence outside the Federal Republic of Germany after conclusion of the Contract or its domicile or personal residence is not known at the time the action is filed. Deutsche Messe is also entitled to bring an action at the Customer's general place of jurisdiction. The place of performance for all obligations arising from this Contract is Hannover.
Should one or more provisions of these GTC be or become invalid, this shall not affect the validity of the remaining GTC and the validity of the Contract.
